Supposing that talk of a distinctively artistic type of value is warranted, what separates it from other sorts of value? Any plausible answer must explain both what is of value and what is artistic about artistically valuable properties. Flaws with extant accounts stem from neglect of one component or the other; the account offered here, based on careful attention to actual art-critical practices, brings both together. The “value” component depends on the capacity of artworks to provide subjectively valuable experiences, while (...) the “artistic” component relies on the specific norms constitutive of artworld institutions. Understanding artistic value in this way allows for progress on several persistent problems, including the ethical value of art, relativism in artistic value, and the proper boundaries of philosophical aesthetics. In this article, I argue, adverting to critical practices, that film adaptations are comparable with the comics that serve as their sources. The possibility of comparison presumes the existence of covering values according to which these comparisons are made. I raise four groupings of covering values for comics—narrative, pictorial, historical, and referential—and show how they apply to film adaptations as well, and argue that a fifth kind of value, fidelity, is relevant to comparisons of source comics to film adaptations. The primary purpose of depictive works of pornography, we take it, is sexual arousal through sexually explicit representations; what we callprototypical pornography satisfies those aims through the adoption of a ceteris paribus maximally realistic depictive style. Given that the purpose of sexual arousal seems best fulfilled by establishing the most robust connections between the viewer and the depictive subject, we find it curious that not all works of pornography aspire to prototypical status. Accordingly, we target for philosophical scrutiny several non-standard (...) but putatively pornographic forms: Tijuana Bibles, hentai manga, and slash-fiction. We find that works of these genres possess certain depictively or fictively oriented properties that appear at least prima facie incompatible with prototypical pornography, and thereby to pose two pressing questions that anyprima facie viable analysis of pornography must answer: the depiction question and the fiction question. By answering these questions, we can not only arrive at a deeper understanding of the aims of pornography and the reasons for which significant sub-genres of pornography might diverge from the prototypical ideal, but also perhaps better understand what lies at pornography’s edge, and so better understand the ways in which pornography might relate to what lies beyond. This article investigates whether or not theories of justice from political philosophy, first, support the position that health research should contribute to justice in global health, and second, provide guidance about what is owed by international clinical research (ICR) actors to parties in low- and middle-income countries. Four theories—John Rawls's theory of justice, the rights-based cosmopolitan theories of Thomas Pogge and Henry Shue, and Jennifer Ruger's health capability paradigm—are evaluated. The article shows that three of the four theories require (...) the conduct of health research for justice in global health. The theories help identify the ends of justice to which ICR is to contribute, but they cannot tell us how to organize ICR to promote these ends. Aside from Ruger's health capability paradigm, the theories also lack an allocative principle for assigning specific duties to specific actors. This creates difficulties for establishing obligations for certain types of ICR actors. (shrink)

“Natural logic” was proposed by Lewis Henry Morgan as the engine of cultural evolution, concluding that the “course and manner” of cultural development “was predetermined, as well as restricted within narrow limits of divergence, by the natural logic of the human mind.” This essay argues that Morgan’s conception of natural logic aids the project of settler colonialism. Rather than being a false account of human agency, however, it is a conception of natural logic that is produced through the systematic (...) narrowing of possibilities for agency, human, and otherwise. This narrowed logic is thus only a part of a differently conceived logic of agency that is also general and normative. The discussion proceeds in four sections: first, a presentation of Morgan’s conception of natural logic and its origins; second, an analysis of four colonizing implications of Morgan’s view; third, examples of further developments of natural logic in the twentieth and twenty-first centuries in the work structuralist and post-structuralist theorists; and, last, a brief introduction of a decolonial logic that provides a broader alternative conception of the structure of agency, human, and otherwise, and that avoids the oppressive effects of the reductionism of the natural logic received from Morgan and his successors. It is a privilege to be invited to contribute to the Festschrift dedicated to Professor Johan Buitendag, Emeritus Dean, Faculty of Theology and Religion at the University of Pretoria, South Africa. While his own work often examined the relationship between theology and natural science, he was also passionate about ecumenism and, in that spirit, the present essay utilised what might be described as an inductive approach to an important ecumenical question, the unity between Methodists and Catholics. Ecumenical dialogue is often (...) undertaken from a theological and dogmatic perspective. This essay took a different approach in that it sought to inductively examine what might be described as the inner logic of two ecclesial systems (Methodist and Catholic). In doing so, it was premised upon an Aristotelian philosophical principle, epistemic fit, in that it presupposed that both these ecclesial bodies possess an intrinsic logic that can be brought to the surface in order to exhibit parallel contours in the wider ecclesial terrain.Contribution: This article fits well within the scope of HTS Teologiese Studies/Theological Studies in that it contributed to a new subdiscipline in epistemology, which explores the conceptual and epistemological dimensions of ecclesiology. Using the concept of epistemic fit, the article offered an inductive approach to some of the practical issues that emerge in ecumenical dialogue. (shrink)

Henry Sheffer’s 1908 Harvard Ph.D. thesis contains an interesting appendix on a central feature of the logical work of his thesis advisor, Josiah Royce. This is the claim in Royce’s 1905 article “The Relations of the Principles of Logic to the Foundations of Geometry” that an unsymmetric ordering relation can be defined on the single symmetric O-relation for which he gives postulates in that paper. Sheffer criticizes Royce’s specific definition from the point of view of the evolving twentieth century (...) conception of axiomatic method and also shows more generally that an unsymmetric1 order relation cannot be defined in the system of the 1905 paper based on the O-relation. A spatial logic is a formal language interpreted over any class of structures featuring geometrical entities and relations, broadly construed. Henry Sidgwick,, philosopher, classicist, lecturer and fellow of Trinity College, Cambridge, and supporter of women's university education, is well known for his Method of Ethics, a significant and influential book on moral theory. First published in 1883, this work considers the role the state plays in economic life, and whether economics should be considered an Art or a Science. Sidgwick applies his utilitarian views to economics, defending John Stuart Mill's 1848 treatise of the same name. The book calls for (...) a return to traditional political economy by eliminating 'needless polemics'. Sidgwick also outlines the need to bridge the gap between his analytical or deductive method and the inductive method employed by Mill's critics, the new generation of economic philosophers including John Elliot Cairnes and William Stanley Jevons. First, a comment on a pessimistic note: Salmon says we can't be sure there is any such thing as inductive inference: in demanding that some explanations have the form of correct inductive inferences, “we may be laying down a requirement which cannot be fulfilled.” To doubt that we can fulfill that requirement is to doubt that we can formalize inductive logic. It may be true, but why begin the fight by throwing in the sponge? It is also true that there (...) are difficulties involved in formalizing acceptance rules for inductive conclusions, but these difficulties may be overcome. It is false to claim that we ‘cannot claim to know exactly’ what these acceptance rules are. Only two years ago I did just that. It was true that my claim was shown to be erroneous a year later, but that fate can befall almost any worthwhile claim. (shrink)

According to the renowned biomimicry specialist, Janine Benyus, biomimicry offers a new way of valuing nature based on the principle of learning from nature. Comparing and contrast­ing this new way of valuing nature with the dominant conception of nature as valuable for the ecosystem services it provides, an articulation of the respective theoretical frameworks of ecosystem services and biomimicry can be proposed. This articulation depends on the insight that each of the four basic categories of ecosystem service identified in the (...) Millen­nium Ecosystem Assessment correlates with a principle of biomimicry —an insight that makes it possible to add a whole new layer of complexity to ecosystem service theory such that it henceforth covers not just what nature does for us, but also what nature may teach us how to do. This articulation of the theoretical frameworks of ecosystem services and biomimicry implies a significant bifurcation of the general normative orientation of EST such that it is no longer oriented primarily or exclusively toward conserving nature, but also toward imitating and following nature. Direct-to-Consumer genomics has been a controversial topic for over a decade. Much work has been done on the legal issues it raises. This article asks a different question: What will DTC genomics and its legal issues look like in ten to twenty years? After discussing the five current uses of DTC genomics, it describes three current legal issues: medical uses, privacy of genomic information, and privacy in collection and analysis of human DNA. It then suggests that changes in human genomics (...) and how it is used will make the first of those DTC genomics legal issues less important in the future, but that the third will be increasingly significant.
